For many, being charged with Driving Under the Influence (DUI) is a frightening introduction to the legal system. DUI clients come from all walks of life, ages, and all socio-economic levels. If you or someone you care about is facing a DUI charge, here's some information you'll want to know:

What do I do now?

The first thing you should do is contact an attorney. An attoney can review the case for defects, move to suppress evidence, compel discovery, have blood samples independently analyzed, negotiate with the prosecutor, obtain expert witnesses for trial, and contest the administrative license suspension, among other things.

What penalties am I facing?

If you are convicted of a DUI, you could be facing jail time, loss of license and a fine. According to the Kentucky Transportation Cabinet:

First Offense Within a Five Year Period

  • $200 - 500 Fine

  • 2 to 30 Days in Jail

  • 90 Days of Alcohol or Substance Abuse Program

  • 30 to 120 Day License Suspension

  • Possible 48 Hours - 30 Days Community Labor

Second Offense Within a Five Year Period

  • $350-500 Fine

  • 7 Days - 6 Months in Jail

  • 1 Year of Alcohol or Substance Abuse Treatment

  • 12 to 18 Month License Suspension

  • 10 Days-6 Months Community Labor

Third Offense Within a Five Year Period

  • $500 - 1,000 Fine

  • 30 Days-12 Months Jail

  • 1 Year of Alcohol or Substance Abuse Treatment

  • 24 to 36 Month License Suspension

  • 10 Days-12 Months Community Labor

Fourth Offense Within a Five Year Period

  • Class D Felony

  • Minimum Term 120 Days Imprisonment Without Probation

  • 1 Year of Alcohol or Substance Abuse Treatment

  • 60 Month License Suspension

How much do you charge?

Many wonder if it is worth it to hire an attorney to defend against a DUI charge. When your liberty and privilige to drive is at risk, the advice of an attorney is essential.
